These Terms of Service ("Terms") govern your access to and use of Dialectic Method Spanish (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The service
Dialectic Method Spanish is an AI-guided spoken practice platform for advanced Spanish learners. It generates synthesized speech from an interlocutor and rubric-formatted feedback. It is an educational tool: it does not substitute for accredited instruction, certification, professional advice, or human evaluation.
2. Eligibility
You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Accounts
- You are responsible for keeping your credentials confidential and for all activity conducted under your account.
- Notify us immediately at security@dialecticmethod-spanish.com of any unauthorized access.
4. Acceptable use
You agree not to:
- reverse-engineer, scrape, or attempt to extract the underlying models or prompts;
- use the Service to generate unlawful, defamatory, harassing, or hateful content;
- circumvent usage limits, access controls, or security measures;
- resell, sublicense, or impersonate the Service.
5. Subscriptions and billing
- Paid plans (Scholar, Fellow) renew automatically until cancelled.
- Prices are shown on the Pricing page and may change with notice; existing renewals keep the contracted price unless otherwise notified.
- Statutory withdrawal rights apply where required by law (e.g., the EU's 14-day right of withdrawal; you may waive it for immediate access to digital content).
- Failed payments may result in a temporary downgrade to the Learner plan.
6. AI-generated content
AI responses and feedback are generated using large language models. They may contain inaccuracies, incomplete reasoning, or biased framing. You retain ownership of your spoken contributions; AI-generated content is licensed to you for personal and educational use. See our AI Disclosure.
7. Intellectual property
We reserve all rights in the Service, including software, prompts, rubrics, topic libraries, and brand assets. You receive a limited, non-exclusive, non-transferable license to use the Service for personal learning purposes.
8. Termination
You may delete your account at any time from Settings → Privacy. We may suspend or terminate accounts that breach these Terms, with reasonable notice unless immediate action is required to protect the Service.
9. Disclaimers
The Service is provided "as is," without warranty of any kind, to the maximum extent permitted by law. We do not guarantee any specific learning outcome, exam result, or professional advancement.
10. Limitation of liability
To the maximum extent permitted by law, our total liability arising from the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited by law (e.g., gross negligence, fraud, statutory consumer rights).
11. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. Mandatory consumer protections of your country of residence continue to apply.
12. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
